The Texas State University (“University”) offers blog/website services (“Services; Service”) to any current faculty, staff or students (“Users”) of the University. Use of these Services is subject to the Terms of Use (“Terms”) contained herein. You must read and agree to these Terms, including any future amendments.
We will attempt to notify you when major changes are made to these Terms; however, Users should periodically review the most up-to-date version available online at https://wp.txstate.edu/terms-of-service/. University may, in its sole discretion, modify or revise these Terms at any time. If you do not accept and abide by these Terms, you may not use the Services.
I – Disclaimer
Websites or blogs published through these Services may include un-moderated dialog containing the personal opinions and expressions of the Users who submitted the entries. Neither the content of these sites or blogs, nor the links to other websites, are reviewed, approved, or endorsed by Texas State University or the Texas State University System. Furthermore, University does not guarantee the truthfulness, accuracy, or reliability of any communications posted, submitted or displayed through the Service.
Although Texas State does not routinely monitor content posted by Users, Texas State reserves the right to remove content that violates these Terms, but is under no obligation to do so.
II – Description of Service
University offers blog/personal website services in support of personal, curricular, and scholarly communications conducted by the University community. These Services are made available to any current faculty, staff or student of the University subject to the terms and conditions of use.
The Service is provided to Users on an as-is and as-available basis. University reserves the right to modify, suspend, or discontinue the Service with or without notice at any time and without any liability to its Users.
III – Proper Use
This Service provides personal website/blog features and functions for University faculty, staff and students. Official University websites must be hosted in the Gato Content Management System as directed in the University Website Policy (UPPS No. 04.01.06).
Users are responsible for maintaining the confidentiality of their Service account and password and accept responsibility for all activities occurring under their account. Users agree that they will not access or attempt to access any other User’s account, or misrepresent or attempt to misrepresent their identity while using the Services.
Users may post content freely through the Services so long as the content is not, in University’s sole judgment, illegal, obscene, defamatory, threatening, infringing on another’s intellectual property rights, or otherwise injurious or objectionable.
URLs are also subject to removal or modification if they are, in University’s sole judgment, misrepresentative, illegal, obscene, defamatory, threatening, infringing on another’s intellectual property rights, or otherwise injurious or objectionable.
Users agree to use the Service in compliance with all applicable local, state, and national laws and all University policies, including but not limited to the Appropriate Use of Information Resources (UPPS No. 04.01.07) , Network Use Policy (UPPS No. 04.01.05), Link Policy, University Websites (UPPS No. 04.01.06), and the Texas State Official Disclaimer.
Use of Texas State computer resources for private business or commercial activities, fund-raising or advertising on behalf of non-Texas State organizations is prohibited. Texas State webpages may link to commercial websites, but any link that generates, or has the potential to generate revenue to Texas State or to any individual or company, including click trade or banner advertising, is prohibited.
By posting content to any blog or website hosted within the Service, Users warrant and represent that (a) they own or otherwise control all of the rights to that content, including, without limitation, all the rights necessary for them to provide, post, upload, input or submit the content, (b) they have obtained written permission from the rights holder that authorizes their manner of use, or (c) their use of the content is a protected fair use. Users agree that they will not knowingly and with intent to defraud provide material and misleading false information. Users represent and warrant also that the content they supply does not violate these Terms, and that they will indemnify and hold Texas State University harmless for any and all claims resulting from content they host within the Service.
Violation of any of the foregoing policies may result in immediate termination of this agreement, and may subject you to university, state and federal penalties.
IV – Privacy
University NetID and WP accounts and passwords are specific to the individual and may not be shared with others.
Each website/blog will display the name and NetID of the site owner on the owner’s site. Thus, site owner anonymity is not a feature of this Service.DO NOT USE THIS SERVICE if you do not want your NetID and name presented on the Web as the party responsible for your website/blog content.
V – Intellectual Property Rights
Users retain all patents, trademarks and copyrights to any content posted, submitted, or displayed through these Services and are responsible for protecting those rights, as appropriate. Other university employment agreements and contracts may supersede this Terms of Service.
All copyright and related rights to original work posted within the Service is owned by and is the sole responsibility of its author(s). Service administrators will never claim ownership over users’ materials.
VI – Termination, Suspension of Service
University may, at its sole discretion, at any time and for any reason suspend or terminate a Users account, amend these Terms, or terminate the Service. In the event of termination, access to the Users account will be disabled and any content contained within may (but is not guaranteed to) remain within the Service for back-up purposes. Users acknowledge that inactive sites, i.e., sites with no additions, changes, or deletions to content for 12 or more consecutive months, are subject to archival and removal from the Service
VII – Indemnification
Users agree to hold harmless and indemnify University, any of its subsidiaries, affiliates, and employees from and against any third-party claim arising from or in any way related to the violation or use of the Service. The indemnification includes any liability or expense arising from all claims, losses, actual or consequential damages, suits, judgments, and litigation costs or attorneys’ fees.

IX – Agreement
These Terms constitute the entire agreement between the User and University University and governs the use of the Services. These Terms supersede any and all prior oral or written agreements with the Users.
